Senate Bill Amounts To Death Penalty For Web Sites
U.S. search engines could be served a court order to block search results. Requiring search engines to remove links to an entire website altogether due to an infringing page would raise free speech concerns regarding lawful content hosted elsewhere on the site. The introduction of this draconian bill shows the utter contempt Obama and his NewWorldOrder cronies have for free speech and the Constitution. This horrific bill would be a step toward less permissive internet environments, such as China's. The bill was criticized for not being specific about what constitutes an infringing web site. The U.S. Department of Justice would receive the power to seek a court order against an allegedly infringing Web site, and then serve that order on search engines, certain Domain Name System providers, and Internet advertising firms--which would in turn be required to "expeditiously" make the target Web site invisible. The fact that an injunction can be issued without notifying the allegedly infringing site, nullifies the legal presumption of innocence. The ability of any private rightsholder to bring legal action against a site via a court and require search engines to censor their search results, may make the law unrealistic. EFF and other like-minded advocacy groups, including the American Library Association and Human Rights Watch, sent a letter last month to the bill's Senate sponsors saying the legislation goes too far. Internet industry trade associations, including the Consumer Electronics Association and NetCoalition, said in a separate letter that Protect IP has a real "potential for unintended consequence and require intense scrutiny and study." All this criticism hasn't done much to slow the bill's momentum so far. On May 26, the Senate Judiciary committee voted unanimously to send the bill to the floor for a vote.
