Former National Security Agency analyst Thomas Drake, is being prosecuted for leaking information about waste and mismanagement at the agency. The New Yorker reveals the Obama administration has used the Espionage Act of 1917 to press criminal charges in five alleged instances of national security leaks—more such prosecutions than have occurred in all previous administrations combined. Gabriel Schoenfeld of the Hudson Institute said, "Ironically, Obama has presided over the most draconian crackdown on leaks in our history—even more so than Nixon." Yale University Professor of Constitutional Law Jack Balkin said the increase in leak prosecutions is part of a larger transformation, what he described as bipartisan normalization and legitimization of a national surveillance state.

Obama: "I'll Make Our Government Open And Transparent"
Washington Examiner - Obama Flouts Open Government: The least Transparent Administration In History!
In reality, Obama is so hostile to open government that “the Obama administration censored 194 pages of internal e-mails about its Open Government Directive,” according to the Associated Press. For example, "it blacked-out one e-mail discussing how to respond to AP’s request for information about the transparency directive.” Moreover, "the Obama administration has developed a reputation for ruthlessly prosecuting whistleblowers for leaks to the press.” It recently demoted a whistleblower who revealed to Congress how the Department of Homeland Security was violating the Freedom of Information Act (FOIA). The Administration discriminates in responding to requests for documents under FOIA. It illegally forces its critics to wait years for the documents to which they are entitled—well beyond the 20-day legal deadline for responding – or refuses to even respond to their requests for documents. Meanwhile, it gives many of its supporters the documents they seek in just a few days. These are just a few of the ways that Obama has broken his promise to have the most transparent administration in history. The Obama Administration repeatedly stonewalled the U.S. Civil Rights Commission, illegally refusing to comply with its subpoenas for information about why the Obama Administration dismissed a lawsuit against black panthers in a high-profile voter -intimidation case, after career Justice Department lawyers had already won that lawsuit by default. It also refused to comply with freedom-of-information requests by watchdog groups investigating that case. Obama's campaign promise to have the most transparent administration in history is not the only campaign promise he has violated. He has also violated many other campaign promises, like his pledge of a "net spending cut," which he immediately flouted after the election through record spending increases and trillions in deficit spending.

Peter Fonda Calls Obama A'Traitor' At Cannes Film Festival
CANNES, France (AFP) – Peter Fonda launched a four-letter attack on US President Barack Obama at the Cannes film festival on Wednesday, calling him a traitor. Fonda -- a keen environmentalist and co-producer of the film which centres on the explosion of the BP oil rig Deepwater Horizon, the ensuing spill and its consequences -- accused Obama of trying to gag reporting on the issue. "I sent an email to President Obama saying, 'You are a f(expletive) traitor,' using those words... 'You're a traitor, you allowed foreign boots on our soil telling our military -- in this case the coastguard -- what they can and could not do, and telling us, the citizens of the United States, what we could or could not do'."

Insane Indiana Supreme Court Rules: You Have No right To Resist Unlawful Police Entry Into Your Home
INDIANAPOLIS - Overturning a common law dating back to the English Magna Carta of 1215, the Indiana Supreme Court ruled Thursday that Hoosiers have no right to resist unlawful police entry into their homes. In a 3-2 decision, Justice Steven David writing for the court said if a police officer wants to enter a home for any reason or no reason at all, a homeowner cannot do anything to block the officer's entry. "We believe ... a right to resist an unlawful police entry into a home is against public policy and is incompatible with modern Fourth Amendment jurisprudence," David said. "We also find that allowing resistance unnecessarily escalates the level of violence and therefore the risk of injuries to all parties involved without preventing the arrest." Justice Robert Rucker, a Gary native, and Justice Brent Dickson, a Hobart native, dissented from the ruling, saying the court's decision runs afoul of the Fourth Amendment of the U.S. Constitution. "In my view the majority sweeps with far too broad a brush by essentially telling Indiana citizens that government agents may now enter their homes illegally -- that is, without the necessity of a warrant, consent or exigent circumstances," Rucker said.

The Supreme Court on Monday ruled against a Kentucky man who was arrested after police burst into his apartment without a search warrant because they smelled marijuana and feared he was trying to get rid of incriminating evidence."Police officers may now knock, listen, then break the door down, never mind that they had ample time to obtain a warrant," said Justice Ginsburg. In her dissent, Ginsburg said her colleagues were giving police an easy way to routinely avoid getting warrants.
